Attorney General Todd Blanche and CNN anchor Dana Bash sparred during an October 25 one-on-one interview on the network's Sunday program, "State of the Union." The debate centered on a federal lawsuit filed by the White House, which seeks to deny the certification of Alaska's election results should Republicans lose a pivotal Senate race in the state.
The Alaska Senate contest, which features incumbent Republican Senator Dan S. Sullivan seeking a third term against Democratic former U.S. Representative Mary Peltola, is currently rated as a "toss up" by the Cook Political Report. The race is one of seven such contests in states won by Donald Trump in 2024. The situation is complicated by the presence of a third candidate, retired schoolteacher Daniel J. Sullivan, who changed his party registration between the primary and general elections and is running with no party affiliation.
During the interview, Bash questioned Blanche on the legal basis for the administration's argument, asking what specific crime was involved after the Attorney General claimed the third candidate's sole purpose was to pull votes away from the incumbent. Blanche responded, "What's the crime? Well it depends. There could be a crime, but the real wrong here is that Alaskans are gonna be confused and will not have their vote heard."
Bash countered by citing the first clause of Article 1, Section 4 of the Constitution, which outlines guidelines for congressional elections, and noted that the Alaska Supreme Court had previously ruled earlier this year that Daniel J. Sullivan could remain on the ballot. Blanche challenged the presentation of the constitutional text, telling Bash, "Well conveniently, you put up the Constitution on your screen, but you highlighted only the first clause. Why don't you show the next clause to your viewers which says that Congress is allowed to pass laws to make sure that happens." He added that the second clause states "but the Congress may at any time by Law" and asserted that the administration is relying on that law for the suit filed earlier in the week.
The interview grew increasingly tense when Bash asked if the Trump administration was attempting to lay the groundwork to overturn the election, drawing a comparison to the events of January 6, 2021. Blanche reacted sharply, laughing and telling the anchor, "Oh stop it. You gotta stop it with that! You're not being a real person. Come on, man. That is crazy!" He further criticized the line of questioning, stating, "You're saying 'Mr. Attorney General, because the president of the United States wants to stop fraud and confusion in Alaska, is he going to do something crazy?' That is not a real question." The pair continued to argue over whether the question was fair.
The Trump administration's lawsuit requests that the state of Alaska be prevented from certifying election results "pending an investigation to determine whether votes cast for Daniel J. Sullivan were meant to be cast for Senator Sullivan." Blanche emphasized that, regardless of court outcomes or the Alaska Supreme Court's previous rulings, the system should not allow a candidate to remain on the ballot for the sole purpose of confusing voters.
